We do not tolerate harassment of participants in any form. This code of conduct applies to all Bluegrass Pride spaces, including our social media channels, our public Facebook group, comments on our website, and at Bluegrass Pride hosted, sponsored, or co-sponsored public and private events. Anyone who violates this code of conduct may be sanctioned or expelled from these spaces at the discretion of the Bluegrass Pride Board, staff, or other representatives. Some Bluegrass Pride spaces may have additional rules in place, which will be made clearly available to participants. Participants are responsible for knowing and abiding by these rules.

1. ACTIVITY DESCRIPTION AND SCOPE
The undersigned participant (“Participant”) desires to participate in Camp Bluegrass Pride, a music education program consisting of indoor music instruction, practice sessions, formal and informal ensemble jam sessions and performances (collectively, the “Camp”). The Camp will take place at the Charlene Larsen Center for the Performing Arts located at 588 16th St, Astoria, OR 97103, during the period of June 21-26, 2026, and other places of public accommodation within Astoria, Oregon. The Camp serves participants of mixed ages including both minors and adults, and involves group learning environments, individual instruction, ensemble practice, and
performance opportunities in an indoor setting.
The Camp may include but are not limited to: individual and group music lessons, ensemble rehearsals, practice sessions with various musical instruments, performance preparation, recitals, and other music-related educational activities. Participants will be working with musical instruments, interacting with instructors and other participants, and engaging in collaborative musical activities throughout the duration of the Camp. Participants are solely responsible for the care, safety and security of any musical instrument that they may bring to Camp.

2. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
The Participant acknowledges and understands that participation in the Camp involves certain inherent risks and dangers that cannot be eliminated regardless of the care taken to avoid injuries.
These risks include, but are not limited to:
General Risks of Group Activities: Risks associated with participating in group activities including but not limited to interactions with other participants, movement within shared spaces, potential for accidents or injuries during group instruction or ensemble activities, risks associated with being in close proximity to other individuals, and the general risks that accompany any group educational or recreational activity.
Musical Instrument Related Risks: Risks associated with the use, handling, and operation of musical instruments including but not limited to potential for physical strain or injury from playing instruments, risk of cuts, bruises, or other injuries from contact with instruments or equipment, hearing-related risks from exposure to musical sounds and amplification, potential
for repetitive stress injuries from extended practice or performance, and risks associated with the physical demands of musical performance and instruction.
Instrument Risks: Risks associated with the potential for damage, theft, or loss of musical instruments and related accessories such as cases, bows, recording and amplification equipment.
Participants are solely responsible for the care and security of such instruments and accessories at all times during the Camp.
Facility and Environmental Risks: Risks associated with the physical premises including but not limited to slips, trips, and falls on floors, stairs, or other surfaces, risks associated with doors, windows, furniture, and other fixtures, potential for accidents in common areas, restrooms, or other facility spaces, and general premises liability risks associated with any indoor facility.
The Participant acknowledges that this list is not exhaustive and that other risks, both known and unknown, anticipated and unanticipated, may also result in injury, illness, or property damage.
The Participant voluntarily assumes all such risks and acknowledges that participation in the Camp is entirely voluntary.

3. RELEASE AND WAIVER OF CLAIMS
In consideration for being permitted to participate in the Camp, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Participant
(and if the Participant is under eighteen (18) years of age, the Participant’s parent or legal guardian) hereby releases, waives, discharges, and covenants not to sue Camp Bluegrass Pride,
its officers, directors, employees, agents, volunteers, instructors, and all other persons or entities acting in any capacity on their behalf (collectively, the “Released Parties”) from all liability to the Participant for any loss or damage, and any claim or demands therefor on account of injury to the person or property or resulting in death of the Participant, whether caused by the ordinary negligence of the Released Parties or otherwise, while the Participant is participating in the Camp or while on the premises where the Camp are conducted.

This release and waiver specifically covers claims arising from the ordinary negligence of the Released Parties. However, this release and waiver does not extend to claims arising from gross
negligence, reckless conduct, or intentional misconduct by the Released Parties, as such conduct cannot be waived under Oregon law.
The Participant understands that this waiver and release is intended to be as broad and inclusive as is permitted by the laws of the State of Oregon, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. This waiver and release has been entered into in reliance upon Oregon law, including recent
legislative changes that have strengthened the enforceability of liability waivers for recreational activities.

4. EQUIPMENT USE AND RESPONSIBILITY
The Participant acknowledges that they may use various musical instruments and equipment provided by Camp Bluegrass Pride during the Camp. The Participant agrees to use all equipment
in a careful and responsible manner, following all instructions provided by Camp staff and instructors. The Participant agrees to inspect equipment before use and to immediately report any
defects, damage, or safety concerns to Camp staff.
The Participant agrees to be financially responsible for any damage to Camp equipment, instruments, or property that results from the Participant’s misuse, negligence, or failure to
follow instructions. Normal wear and tear from proper use is expected and will not result in charges to the Participant. However, damage resulting from careless handling, improper use, intentional misuse, or failure to follow safety instructions will be the financial responsibility of the Participant (or the Participant’s parent or guardian if the Participant is a minor).
The Participant agrees to return all borrowed equipment in the same condition as received, reasonable wear and tear excepted. Any lost or stolen equipment will be charged to the Participant at replacement cost. The Participant acknowledges that they are responsible for the security of any equipment checked out to them and should not leave equipment unattended or allow others to use equipment assigned to them without permission from Camp staff.

5. INSURANCE PROVISIONS
The Participant acknowledges and agrees that they are required to maintain their own health insurance coverage that will provide adequate coverage for any injuries or medical conditions that may arise during participation in the Camp. The Participant represents that they have adequate health insurance coverage or, alternatively, agree to be personally responsible for any medical expenses incurred as a result of or in connection with participation in the Camp.
The Participant acknowledges that Camp Bluegrass Pride may maintain general liability insurance, but such insurance is limited in scope and may not cover all potential claims or damages. The Participant acknowledges that Camp Bluegrass Pride’s insurance is not intended to serve as primary coverage for participant injuries and that participants should not rely on such insurance for their protection.
The Participant agrees that they will not make any claim against any insurance policy maintained by Camp Bluegrass Pride except to the extent that such policy specifically provides coverage for
participant injuries, and then only after exhausting their own insurance coverage. The Participant acknowledges that they have been advised to review their own insurance policies to ensure adequate coverage for participation in recreational and educational activities.

6. GOVERNING LAW AND LEGAL PROVISIONS
This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the appropriate courts of the State of Oregon, and the parties hereby consent to the jurisdiction of such courts.

Severability: If any provision of this Agreement, or any portion thereof, is held to be invalid, illegal, void, or unenforceable by any court or tribunal of competent jurisdiction, the remainder of this Agreement shall remain in full force and effect to the maximum extent permitted by law. The parties agree that any such invalid, illegal, void, or unenforceable provision shall be modified and limited in its effect to the extent necessary to cause it to be enforceable, or if such modification is not possible, shall be deemed severed from this Agreement. In such event, the
parties shall negotiate in good faith to replace any invalid, illegal, void, or unenforceable provision with a valid, legal, and enforceable provision that corresponds as closely as possible to
the parties’ original intent and economic expectations.

Integration: This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and
understandings, whether written or oral, relating to such subject matter. This Agreement may not be modified or amended except by a written instrument signed by both parties.

Legal Changes: This Agreement has been drafted in consideration of recent changes to Oregon law that have strengthened the enforceability of liability waivers for recreational activities. The parties acknowledge that the legal landscape regarding liability waivers continues to evolve, and
this Agreement includes comprehensive waiver language designed to remain enforceable under current and anticipated future Oregon law.

7. PARTICIPANT ACKNOWLEDGMENT AND SIGNATURE
FOR ADULT PARTICIPANTS (18 YEARS OF AGE OR OLDER):
I acknowledge that I have read this entire Waiver and Release of Liability, understand its contents, and sign it voluntarily. I understand that this is a release of liability and a contract
between myself and Camp Bluegrass Pride, and I sign it of my own free will. I understand that I am giving up substantial rights by signing this Agreement, including my right to sue for ordinary
negligence. I acknowledge that no oral representations, statements, or inducements apart from this written Agreement have been made.

The Participant grants to Camp Bluegrass Pride and its authorized representatives the irrevocable and unrestricted right to use and publish photographs, video recordings, audio recordings, and other media of the Participant taken during the Camp. This grant includes the right to edit, alter, copy, exhibit, publish, or distribute such media for any lawful purpose including but not limited to promotional materials, educational materials, website content, social media posts, brochures, advertisements, and other marketing or educational purposes.

The Participant acknowledges that such media may be used without compensation to the Participant and that Camp Bluegrass Pride will own all rights to such media. The Participant waives any right to inspect or approve the finished product or products or the advertising copy or other matter that may be used in conjunction with such media or the use to which it may be applied.

The Participant releases Camp Bluegrass Pride and its authorized representatives from any claims, damages, or liability arising from or related to the use of such media, including but not limited to claims for invasion of privacy, defamation, or violation of rights of publicity. This consent and release will remain in effect indefinitely unless revoked in writing by the Participant, provided that any revocation will not affect media captured and used prior to the date of revocation.
